1. Acceptance of Terms

1.1 By clicking “I Accept” or by using our services, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions, as amended from time to time.

1.2 If you do not agree to these terms, please click “I Reject” and discontinue use of our services immediately.

2. Changes to the Agreement

2.1 MTAG Health Solutions Namibia (Pty) Ltd reserves the right to modify, amend, or update these Terms & Conditions at any time without prior notice.

2.2 Continued use of our services following any changes constitutes your acceptance of the revised terms.

3. Use of Service

3.1 You agree to use our services only for lawful purposes and in accordance with these Terms & Conditions.

3.2 You are responsible for providing accurate and complete information when using our services.

3.3 You agree not to misuse our services or assist anyone else in doing so.

Emergency Services Disclaimer (Supplementary Only)

Meditag is NOT a replacement for emergency services (10111 or your local emergency number). In any life-threatening emergency, ALWAYS call your local emergency number FIRST.

Meditag’s emergency alert system is a supplementary service. Alerts depend on internet connectivity and are sent to your designated contacts and registered response partners only. We do not directly contact government emergency services.

4. Data Handling and Partner Agreements

4.1 Data stored on Meditag servers may originate from data input by partner facilities or organizations.

4.2 The collection, processing, and handling of such data shall be governed by the specific agreement between Meditag and the respective partner.

4.3 In cases where a partner’s agreement grants them ownership or exclusive rights to the data, Meditag acts solely as a secure host.

4.4 If a partner refuses to release data to a patient—or to a third party authorized by the patient—Meditag is bound by its contractual obligations with the partner and cannot release the data without breaching that agreement.

5. Data Protection and Privacy

5.1 Your personal and medical data is collected, processed, and stored in accordance with our Privacy Policy and applicable Namibian data protection laws.

5.2 You consent to the collection and use of your data as described, including for service improvement and emergency response purposes.

5.3 Meditag takes reasonable steps to protect your data; however, you acknowledge that no system can be completely secure.

6. Disclaimer of Warranties

6.1 Our services are provided on an “as is” and “as available” basis without any warranties, express or implied.

6.2 MTAG Health Solutions Namibia (Pty) Ltd does not warrant that the service will be uninterrupted, error-free, or completely secure.

7. Limitation of Liability

7.1 In no event shall MTAG Health Solutions Namibia (Pty) Ltd be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of our services.

7.2 This limitation applies even if MTAG Health Solutions Namibia (Pty) Ltd has been advised of the possibility of such damages.

8. Indemnification

8.1 You agree to indemnify, defend, and hold harmless MTAG Health Solutions Namibia (Pty) Ltd, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from your breach of these Terms & Conditions or misuse of our services.

9. Data Breach and Security Disclaimer

9.1 While MTAG Health Solutions Namibia (Pty) Ltd employs industry-standard measures to safeguard data, we cannot guarantee absolute security.

9.2 In the event of a data breach, MTAG Health Solutions Namibia (Pty) Ltd will take immediate steps to mitigate the impact, notify affected users as required by law, and cooperate with regulatory authorities.

9.3 You acknowledge and accept that MTAG Health Solutions Namibia (Pty) Ltd shall not be held liable for any losses or damages resulting from unauthorized access or data breaches, provided that we have taken reasonable security measures.

10. Termination

10.1 MTAG Health Solutions Namibia (Pty) Ltd reserves the right to terminate or suspend your access to the services at its sole discretion, with or without notice, for any breach of these Terms & Conditions.

10.2 Upon termination, your right to use the services will immediately cease, and you must promptly destroy all materials obtained from the service.

11. Governing Law and Dispute Resolution

11.1 These Terms & Conditions shall be governed by and construed in accordance with the laws of Namibia.

11.2 Any disputes arising from or relating to these Terms & Conditions shall be subject to the exclusive jurisdiction of the Namibian courts.

12. Intellectual Property

12.1 All content, trademarks, and intellectual property rights related to the services are the property of MTAG Health Solutions Namibia (Pty) Ltd or its licensors.

12.2 You agree not to reproduce, duplicate, or exploit any part of our services without express written consent.

13. Force Majeure

13.1 MTAG Health Solutions Namibia (Pty) Ltd shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including, but not limited to, natural disasters, acts of government, or internet service provider failures.

14. Severability

14.1 If any provision of these Terms & Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining terms will remain in full force and effect.

15. Entire Agreement

15.1 These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and MTAG Health Solutions Namibia (Pty) Ltd regarding your use of our services.
